Terms & Conditions

As the Owner or Representative Person. The Client warrant that, in entering into this agreement, is either the owner of the Goods or the authorised agent of the owner.

 

By hiring our services, the Client enters into this contract and accept these Terms and Conditions on behalf of all other persons on whose behalf they are acting.

 

 

1.DEFINITION AND INTERPRETATION

01.1 “Kangoo Express” means sole trader ABN 97 623 004 384, trading as KANGOO EXPRESS Transport and Installation Solution Pty Ltda. “We” means each Principal Contractor who performs services under contract and, except in relation to provisions of these terms and conditions which relate solely to the performance of Services, Kangoo Express Transport and Installation Solution, and “Us” and “Our” have the corresponding meaning.

01.2 "Client" means the person who requests KANGOO EXPRESS to arrange for the carriage of goods or for the performance of other work or services on its behalf.

01.3 “Person, you and your” shall include any servant or agent or "Associate" of that person.

01.4 "The team" shall mean any person or contractor who has appointed KANGOO EXPRESS as the agent to find work on behalf of that person/contractor.

01.5 “Our” shall include any person or contractor, asset or action related to KANGOO EXPRESS.

01.6 "Goods" shall mean any goods which the CLIENT has requested to be carried or arranged to be carried.

2.CLIENT’S OBLIGATIONS AND WARRANTIES

 

02.1 The Client warrant that any information provided to KANGOO EXPRESS on which We have reasonably relied in assessing any quotation or estimate of the resources necessary to carry out the work is accurate.

 

02.2 Presence at Loading/Unloading. The Client ensures presence or shall provide an authorised representative to be present on-site at all times from the start to the finish of the job.

KANGOO EXPRESS will not be held responsible if the Client or a representative is not present at all times or fail on ensuring that the correct goods are loaded and shall pay all additional charges whatsoever resulting from the movement of incorrect goods or non- movement of goods that the Client intended to have moved in addition, Kangoo Express will not accept any form of timing dispute when the Client and or a representative is not present during the entire process of the move.

 

02.3 You will ensure that You or some person on your behalf is present when the Goods are loaded or unloaded, except if they are being unloaded into or loaded from the Company storage.

 

02.4 Dangerous Goods. You warrant that the Goods do not include any firearms or goods which are or may become of a dangerous, corrosive, highly combustible, explosive, damaging or harmful nature nor likely to encourage any vermin or pest unless You have disclosed to Us in writing the presence and nature of any such items prior to them being made available to Us for loading or storage. We may refuse to move or store such items.

 

02.5 The team cannot and reserves the right to not move goods that are hazardous, unlawful, illegal, stolen, flammable, explosive, volatile, perishable or anything that poses a risk to any person, property, to the truck and company assets or the environment.

 

02.6 Fragile Goods and Valuable Items. You will, prior to the commencement of the removal or storage, give to Us written notice of any Goods which are of a fragile or brittle nature and which are not readily apparent as such, or which comprise jewellery, precious objects, documents, works of art, money, collections of items or precision equipment, in any case, having a value in excess of$1,000.

02.7 Our tools are crucial to us, much like your furniture is to you. In the event of damage occurring to our tools or materials while handling items, the client will be liable for covering the replacement cost of the damaged material, including items such as trolleys, dollies, and blankets.

 

 

3.METHODS OF REMOVALS

03.1 Mode of Carriage. KANGOO EXPRESS shall be entitled to carry the Goods by any reasonable route (having regard to all the circumstances including the nature and destination of any other Goods being carried on the vehicle) and by any reasonable means.

 

03.2 KANGOO EXPRESS may hire or engage subcontractors to fulfil the services under this Agreement.

03.3 The Client is responsible and shall ensure that the workplace is compliant with WHS regulations. KANGOO EXPRESS reserve the right to decline to start a removal, ate the Client expenses if the removal site is not compliant with WHS regulations.

 

03.4 Arrival time cannot be guaranteed. Arrival within 2 hours of the booked start time can be expected, particularly for afternoon bookings and during peak times. No discounts or refunds will be provided due to late arrival.

 

03.5 KANGOO EXPRESS shall have the right to defer or refuse delivery at the Client's expense should it become apparent that the Client is unwilling or unable to pay any due charges in the required form or at the required place or time.

 

03.6 The team is not obligated to assist with the disconnection and reconnection of the Client's appliances (e.g. washing machine, dishwasher, Tv, Foxtel, etc.), since it should be permed by the skilled trade specialist. In cases that the team is willing to do so, we cannot be held responsible if the goods have not been installed correctly, as this is the sole responsibility of the customer.

 

03.7 The team will not be held responsible for ensuring that the premises, including doors and windows, are locked, as this is the sole responsibility of the Client.

 

03.8 Delivery KANGOO EXPRESS shall not be bound to deliver the Goods except to Client or a person authorised in writing by Client to receive the Goods. If KANGOO EXPRESS cannot deliver the Goods either because no authorised person is present to receive them upon arrival, or because KANGOO EXPRESS cannot gain access to the premises, or for any other reason beyond Kangoo Express control, Kangoo Express will be entitled to unload the Goods into a warehouse, and will be entitled to charge an additional amount for storage and for the subsequent deliver of the Goods. In this instance, Kangoo Express will endeavour to contact the Client to ascertain whether Client have any alternative instructions.

 

03.9 Fortuitous Event KANGOO EXPRESS will not be liable for any delays due to circumstances beyond its control, including industrial disputes, riots, war, weather, property access, traffic and road conditions or the failure of the international sea or air carrier(s) to transit the Goods within the agreed time frames.

 

 

4.SPECIAL ITEMS

04.1 Please notify our office if you have any of the following items: Double Door Refrigerator, Piano, Pianolas or Organs, Safes, Spas, Pool Tables, Over heavy Items, Items made from marble or granite, Commercial equipment i.e. Fridges, Ovens, Pot Plants, Animal Enclosures, Fish Tanks, or any challenging item to be moved.

04.2 For Built-in Items or item which requires specialist skill on dismantling, assembling or reassembling, and carrying; The team when and if willing to perform the move, will only proceed after the waiver of liability for breakage incurred is signed and dated by the client.

 

04.3 We reserve the right to apply charges and fees to Special Items and / or not to move the item if the office was not informed at the time of the booking.

04.3.1 Definition of Special Item Classes and Fees:

a. Class A: i. Any item that weighs over 70kg or requires transportation through challenging conditions, including but not limited to over balcony, over fence, spiral staircases, or through windows. Fee of $120.00

b. Class B: i. Any item that weighs over 100kg or requires transportation through challenging conditions, including but not limited to over balcony, over fence, spiral staircases, or through windows. Fee of $ 150.00

 

c. Class C: i. Any item that weighs over 150kg or requires transportation through challenging conditions, including but not limited to over balcony, over fence, spiral staircases, or through windows. Fee of $180.00

d. Class D: Any Item that requires transportation through human extreme challenging condition .Fees for Class D items will be determined through mutual agreement between the client and Kangoo Express.

 

 The clients must provide accurate information regarding the weight and nature of Special Items at the time of booking to ensure appropriate resources and charges are allocated.

Kangoo Express reserves the right to assess the actual weight and handling requirements of Special Items upon arrival, and fees may be adjusted accordingly.

Kangoo Express reserves the right to deny the removal of any special item without refunding the booking fee or any money paid in advance.

5.FEES AND CHARGES

05.1 Payment, The Client agrees to pay Kangoo Express to all amount due or charges upon delivery of goods, unless agreed by the Parties in writing. The non-payment will resolve under the Fair Debt Collection Practices Act.

 

05.2 Our prices are charged at an hourly rate basis and are exclusive of GST. A minimum fee is given to cover the initial hour/s of the job and then charged in 30-minute increments.

 

05.3 Our basic rates start from the end of the travel to the first pick-up point, loading of goods, until the completion of the work (includes timing in charging, organization of the truck and final assessment of the property). However, in the case where an initial pick up or final drop-off is located more than 30km from KANGOO EXPRESS BASE (DEE WHY, 2099), we are going to charge in excess the travel time from DEE WHY, 2099 going to the pick-up or the return travel from the delivery address going back to DEE WHY, 2099, whichever is applicable.

 

05.4 Long-distance jobs will be charged whilst the team are still onsite. The team will calculate the time it will take them to arrive back at our depot based on Google maps at the time of the completed move. We allow for a 20-minute deviation of time a delay is caused from something out of our control. This could be from but not limited to a traffic accident and weather.

 

05.5 Penalty Rates, In cases where the client fails to provide the accurate inventory description and the working hours goes after 5pm on the day, a penalty rate of 1.5* (+50%) will incur from 5 pm until the completion of the job.

 

05.6 Additional Work the work Client ultimately requires Kangoo Express to perform additional work from the work for which a quotation or estimate has been given, Kangoo Express will also be entitled to make the additional charges based on the hourly rate provided.

 

05.7 A cleaning fee of $50.00 may be applicable for goods to be moved that may cause dirt that will cause cleaning the vehicle afterwards.

 

05.8 The Client is obligated to secure parking space for our removalists. Any tolls or parking fines incurred during the relocation will be charged to the client if we are unable to get an adequate and legal parking space at the surrounds of the premises.

 

05.9 Any waste disposal fees incurred during the relocation(s) will be charged to the client. If no other means of payment is advised, payment will be taken via the credit card provided upon booking.

 

05.10 Standard Upright Pianos and Pool tables are considered special items and incur a $180.00 plus 3.30/step surcharge (with a maximum of 3 steps). Removal must be pre-arranged and is subject to approval.

 

05.11 Insurance Kangoo Express offers to arrange for the goods to be insured during the transit, and the details of the type of insurance will be provided upon request. The excess amount that must be paid in order to make a claim is $500. This amount must be paid in full by the Client unless agreed otherwise in writing by the Client and Kangoo Express.

 

05.12 Reservation In the event Client does not pay in full, Kangoo Express Remedies has the right to retain Client’s Goods subject to this agreement.

 

6.LOSS OR DAMAGE

06.1 Inherent Risks certain goods (including electrical and mechanical appliances, computer equipment, scientific instruments and certain musical instruments) are inherently susceptible to suffer damage or disorder upon removal. Kangoo Express will not be accountable for loss or damage of the goods unless that damage or disorder results from the lack of care and skill on the part of Kangoo Express, its employees or subcontractors.

 

06.2 To avoid losses and damages, the team is not obligated to move any goods or items that it is not properly packed in boxes and sealed bags. The client needs to ensure that the furniture and white goods are fully empty and clean, items that it is not according to the above description will need to be emptied on site and dirty items will be wrapped in plastic wrap at the Clients expense.

 

06.3 Kangoo Express will not be liable if the Goods sustain damage by reason of defective or inadequate packing or unpacking, and the packing or unpacking (as the case may be) was not undertaken by Kangoo Express, its employees or subcontractors.

 

06.4 The client is responsible to ensure that all items can fit through doors and staircases, Kangoo Express is not responsible for damages incurred at the property due to manoeuvrings of items through tight and/or narrow spaces, where the client has been informed of the risk of damage or loss to property relating to access and the client instructs the team to proceed with the supply of removal services despite that information.

 

06.5 Kangoo Express will not be liable for any loss or damage nor any delay which results from any cause beyond its control. Under no circumstances will

Kangoo Express be responsible for any loss or damage involving the restoration or reconstruction of information or data or any item if so-called consequential loss. Kangoo Express will not cover cosmetic damages that might occur during transportation unless the Client has requested a report condition from the items.

 

06.6 Notification of Loss or Damage In case of loss or damage incurred, the Client Must notify Kangoo Express within 48hours after the date of delivery. Kangoo Express will have the best chance of locating any misplace items or ascertaining the cause of damage.

 

06.7 Limitation of Liability Kangoo Express maximum liability shall be the estimate of the value of the goods which client has provided to Kangoo Express.

 

7.WEATHER CONDITIONS

07.1 Kangoo Express shall not liable for any damage or loss to property relating to the weather:

07.2 Occurring during the supply of removal services;

 

07.3 Where the client is aware, or ought to be aware, of the risk of damage or loss to property relating to weather and the client instructs the team to proceed with the supply of removal services; or

 

07.4 Where a client has been informed of the risk of damage or loss to property relating to weather and the client instructs the team to proceed with the supply of removal services despite that information.

 

 

8.INSURANCE and CLAIMS

08.1 Transit and Public Liability insurance is included in the removal rate quoted.

08.2 Despite all the care and expertise, we take, accidents can still happen and some things are outside our control. We will Endeavor to ensure there is no loss or damage, but we do recommend you take out insurance.

 

08.3 It is the customer’s obligation to indicate if they request a report condition to be performed to all items of the move (note that it may vary the time of the removal services in up to 50%), if not requested, the team will use expertise and training to ensure, however, we may not be able to generate evidence of damage during transit or move.

 

08.4 All claims and breakages must be notified within 48 hours upon move completion, otherwise, we do not hold entitled to any breakages or loss.

 

9.CANCELLATION POLICY

09.1 In the event of a job cancellation, the booking fee is non-refundable.

 

09.1.1 In an instance where a job is cancelled with more than 48 hours prior notice, the booking fee can be used as a credit towards to any of our services. This credit option allows you to reschedule your service without losing the initial booking fee, ensuring that you can still benefit from our services at a later date, the booking fee is valid for 1 year.

09.1.2 Any move cancelled with less than 48 hours notice will incur a one-hour penalty based upon the hourly rate quoted, which will be deducted from the booking fee and/or charged from the credit card provided upon booking. 

09.2 Any move cancelled once our removalists are en-route or onsite will incur the $300.00 minimum charge of the move. This fee will be charged to the credit card provided on the booking of the job.

09.3 Moves can only be cancelled by call or text message up during office hours 7:30 am - 5 pm M-F, 8 am-3 pm Sat/Sun AEDT or by email at any time.

 

 

10.ESTIMATES AND QUOTES

10.1 Quotations are valid for two (2) days after issued, prices may vary up or down after the two (2) days and any extensions must be agreed to in writing.

10.2 All moving estimates given cannot be considered a fixed cost. The minimum fee is not a fixed cost of the move.

 

10.3 If a fixed quote has been issued by our office we reserve the right to amend this quote if full disclosure of items moved change after the fixed quote was issued and if there are any access issues or change at the inventory provided that were not fully disclosed at the time of the fixed quote was issued.

 

10.4 For fixed price removals, 50% of the total cost is due immediately upon booking. Payment in full must be received at least 48hours before the commencement of the move.

 

10.5 The 50% deposit required for a fixed price relocation is non-refundable if a cancellation is made less than one (1) week prior to the commencement of the move.

11.PAYMENTS OF SERVICES PROVIDED

11.1 Payment is due in full on completion of the removal on the day.

 

11.2 We accept cash or credit card as forms of payment (VISA or MASTER Cards).

 

11.3 Master and VISA cards incur a 2% surcharge. We do not accept Diners.

 

11.4 Cheque’s are not accepted unless pre-authorized by the office manager.

11.5 Please note that your credit card that was supplied at the time of booking will be debited on completion of the move if no other payment form is made.

 

11.6 Companies may be given a four-day trade account on the provision that a valid ABN is given at the time of booking.

12.APPLICABLE LAW

12.7 The law which governs this agreement will be the law applicable in the place in which the agreement.

The above Terms and Conditions set out the rights and obligations of both the Client (“You” or “Your”) and the Company (“Kangoo Express,” “We,” “Us,” or “Our”) in relation to the removal and storage services offered by the Company.
